1.
Site Agreement
By
entering and using the LANDEX Remote Site, you accept these
Terms and Conditions and agree to be legally bound and subject
to them. Acceptance of the Terms and Conditions creates a
binding legal agreement between you and Optical Storage
Solutions, Inc. that you will comply with the Terms and
Conditions and use the Site only in a manner that is consistent
with these Terms and Conditions. Your use of the Site is
conditioned on these Terms and Conditions and your compliance
with them. If you do not agree to the Terms and Conditions, do
not access the Site or use any of its services.
The Terms and Conditions may be updated or changed from
time to time and you should check this page periodically.
Members
who violate the Terms and Conditions may have their membership
terminated, revoked, services cancelled, or portions thereof,
suspended, deleted or removed without warning.
This
Site supports temporary cookies and uses JavaScript.
These cookies are deleted when the internet browser is
closed.
All
of the material on the LANDEX Remote Site and displayed in the
LANDEX Remote Client software program is protected by the
copyright laws of the U.S. and other countries, both as
individual works and as a collection. You are only allowed to
use these materials as indicated on the LANDEX Remote site;
other uses are prohibited by copyright laws.
You may not copy, reproduce, retransmit, distribute,
publish, commercially exploit or otherwise transfer any
copyrighted material in any format, electronic or otherwise.
2.
LANDEX Remote Membership Agreement
LANDEX
Remote Membership is available to anyone who registers all
required information (including an accurate, legitimate email
address) and obtains a unique Username and Password.
Employees of the same company
may use the
software on multiple computers, all using the same User
Id. A copy of the LANDEX
Remote Client software will need to be downloaded on each
computer. The
software may be used concurrently on multiple computers.
A
minimum deposit of $25 is required each time money is placed on a
debit account. A
transaction service fee of $25 will be charged for all refunds
and transfers. If
an account needs to be closed, the support line should be called
for a refund.
Optical
Storage Solutions, Inc. will not send unsolicited email. All
LANDEX Remote emails, including newsletters and announcements,
will contain information on how to unsubscribe from that email
list. In the event that you receive an email that you think is
unsolicited, please follow the instructions contained in the
email for letting us know and Optical Storage Solutions, Inc.
will make every effort to have your email address removed from
future mailings.

issues may be addressed with Optical Storage Solutions, Inc. by

Fifteen minutes of free telephone support is available for
installation assistance at 800-370-2836 Monday through Friday
from 8:30 am to 4:30 pm, excluding holidays.

LANDEX Remote-Client Software Agreement
LANDEX
Remote Client Software works on various operating systems.
There is no guarantee that this software will work
properly with your system.
Optical Storage Solutions, Inc. will not be held
responsible for any installation problems. After downloading the software, the trial demonstration
should be performed to ensure the program works adequately on
your computer.

Agreement with Optical Storage Solutions, Inc. and
Affiliated Counties
Optical
Storage Solutions, Inc. is merely a central agent between
members and county sites. No warranty of site availability and accuracy of data is
guaranteed by Optical Storage Solutions, Inc.
Subscriber
agrees that the information libraries are provided "as
is"; the Counties and Optical Storage Solutions, Inc., make
no representation or warranty with respect to their accuracy,
completeness, or timeliness; and County and OSS specifically
disclaim any other warranty, expressed, implied, or statutory,
including any warranty of merchantability or fitness for
particular purpose. County and OSS shall not be liable on
account of any such errors, omissions, delays, or losses unless
caused by their gross negligence. In no event shall County or
OSS be liable for the results of any subscriber's use of the
information libraries, for their inability or failure to conduct
their business, or for indirect, special, or consequential
damages. Additionally, subscriber agrees not to replicate or
distribute in bulk any information contained in the libraries.
The data being accessed
is of Public Record and can be accessed by anyone either by
physically entering the County office in said county or by
enrolling with Landex to obtain a copy of the public
record.
5.
LANDEX Remote Security Agreement
Optical
Storage Solutions, Inc. operates secure data networks protected
by industry standard firewall and password protection systems.
Our security and privacy policies are periodically reviewed and
enhanced as necessary, and only authorized individuals have
access to the information provided by our customers.
Any other particularly sensitive information, such as a
customer's credit card number collected for a commerce
transaction, is also encrypted prior to transmission.
Credit
card information will not be stored after this Site is exited.
Each time your account is accessed to increase your debit
account, your credit card information will need to be entered
again.
Optical
Storage Solutions, Inc. has always been committed to protecting
the privacy of our users. We
are committed to making your LANDEX Remote experience enjoyable
and safe. When you download our software and register for our
online services, the information you provide to us is used only
to customize your account. The names and email addresses you
give us are NOT sold, compiled into any type of mailing list, or
otherwise used for any type of email solicitation.
You
the consumer are ultimately responsible for the security of your
LANDEX Remote Member name and password.
Please take care to store your LANDEX Remote Member name
separately from your account password, or better yet, choose a
password that you don't need to write down at all.
6.
Conclusion
By
becoming a LANDEX remote member, you agree to indemnify LANDEX
remote for any claims resulting from your violation of these
terms and conditions. You
agree to indemnify and hold Optical Storage Solutions, Inc., its
subsidiaries, affiliates, officers, agents, and any other
partners and employees harmless from any and all losses,
expenses, damages or costs, including reasonable attorneys’
fees, resulting from any violation of these terms and
conditions, your use of the LANDEX remote service, and the
conduct of another accessing the LANDEX remote service through
your membership. Optical
Storage Solutions, Inc. makes no warranties to its members.
Optical Storage Solutions, Inc. expressly disclaims any
and all warranties of any kind, whether expressed or implied,
including but not limited to the implied warranties of
merchantability, fitness for a particular purpose and
non-infringement.
You
expressly acknowledge and agree that Optical Storage Solutions,
Inc. will have no liability for special, incidental, indirect or
consequential damages of any kind in connection with your use of
the LANDEX remote site, even if you have been advised of the
possibility of such damages.
This
Agreement will be governed and construed in accordance with the
laws of the State of Pennsylvania, without regard to its
conflict of laws provisions. By using the LANDEX Remote Site you
agree to personal jurisdiction of the state and federal courts
of the State of Pennsylvania.
Optical
Storage Solutions, Inc. may amend these Terms and Conditions at
any time. You agree
that Optical Storage Solutions, Inc. reserves the right to amend
these Terms and Conditions at any time, for any reason, and
without notice, including the right to terminate LANDEX services
or any part of the services.
These
Terms and Conditions are the entire agreement between you and
Optical Storage Solutions, Inc. and govern your use of the
LANDEX Remote Site and services. This agreement supersedes any
prior agreements between you and Optical Storage Solutions, Inc.
The failure of Optical Storage Solutions, Inc. to enforce any
right or provision of this agreement does not constitute a
waiver of the right or provision. If any portion of this
agreement is deemed to be invalid, the other portions of the
agreement will remain in full force and effect.
